Welcome to nightmaregaming.shop (the "Site"), operated by Nightmare Gaming, LLC ("Nightmare Gaming," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site and the purchase of products offered through it, including The Rook, The Knight, The Skewer, and any other products we may offer (the "Products"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement.

2. Products & Availability

All Products are handcrafted using 3D printing technology and are made to order unless otherwise noted on the product page. Because Products are custom-manufactured, minor variations in color, texture, and finish between units are normal and are not considered defects.

We reserve the right to limit quantities, discontinue a Product, or refuse any order at our discretion, including in cases of suspected fraud or errors in pricing or product information.

3. Pricing & Payment

All prices are listed in U.S. dollars and do not include applicable sales tax, which is calculated at checkout. We reserve the right to change prices at any time without prior notice; the price charged will be the price displayed at the time your order is placed.

Payment is processed securely through our third-party payment providers at the time of order. We do not store your full payment card information.

4. Production & Shipping Times

Because Products are made to order, please allow the estimated production time listed on the product page (typically 7–10 business days) in addition to shipping time (typically 5–7 business days domestic) before your order arrives. These are estimates, not guarantees, and may be extended during high-demand periods such as convention season.

5. Returns, Exchanges & Refunds

6. Intended Use

Our Products are designed as gameplay accessories for tabletop trading card games. They are not toys and are not intended for children under 3 due to small parts. Use Products on a stable, flat surface and avoid exposing PLA-based items to prolonged heat or direct sunlight, as PLA may warp.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, product designs, and images, is the property of Nightmare Gaming, LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

Nightmare Gaming products are independently designed accessories intended for use with third-party trading card games. We are not affiliated with, sponsored by, or endorsed by Wizards of the Coast or any trading card game publisher.

8. User Conduct

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorized access to our systems, or to interfere with the proper functioning of the Site.

9. Limitation of Liability

To the fullest extent permitted by law, Nightmare Gaming, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Products. Our total liability for any claim arising from your order shall not exceed the amount you paid for the Product giving rise to the claim.

10. Disclaimer of Warranties

The Site and Products are provided "as is" and "as available" without warranties of any kind, express or implied, except as expressly stated in our Return & Exchange Policy or required by applicable law.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Orange County, Florida, and you consent to the jurisdiction of such courts.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
